Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and EasyScale ("EasyScale", "we", "us"). By creating an account, starting a trial, or otherwise using the EasyScale website or platform (the "Service"), you agree to these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that company, and "you" means that company.

If you do not agree to these Terms, do not use the Service.

2. The Service

EasyScale is a software platform that tracks how AI search engines answer questions relevant to your product, generates and publishes content to your website, and reports on the results. Parts of the Service rely on third-party AI models, search engines, and publishing platforms that we do not control.

3. Your account

• You must provide accurate account information and keep it current.
• You are responsible for all activity under your account and for keeping your credentials confidential.
• You must be at least 18 years old to use the Service.

4. Plans, trials, and billing

Paid plans. Paid subscriptions are billed in advance on a recurring monthly basis through our payment processor, Stripe. By subscribing you authorize us to charge your payment method each billing period until you cancel.

Free trial. Trials require a valid payment method. Unless you cancel before the trial ends, your subscription begins automatically and your payment method is charged when the trial period expires.

Cancellation. You may cancel at any time from your account or by contacting us. Cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods or unused capacity.

Free plan. If you use the Service with your own third-party API keys, you are responsible for those keys, for the charges those providers bill you directly, and for complying with those providers' terms.

Changes. We may change our prices with at least 30 days' notice; changes apply from your next billing period.

5. Your site and your content

To publish content, you connect the Service to your website or other platforms. You grant us permission to access those systems on your behalf for that purpose, and you represent that you have the right to grant it.

You own the content the Service generates and publishes for you ("Output"). You are responsible for reviewing Output and for everything published on your properties, including its accuracy and its compliance with applicable law and third-party platform rules. Approval features are available in the Service; whether or not you use them, publication to your properties happens under your instruction and control.

6. AI-generated content

Output is produced by machine-learning models. It may contain inaccuracies, omissions, or statements that do not reflect your product or the current state of the world, and it may resemble content generated for others. You are responsible for reviewing Output before relying on it. The Service is not a source of legal, medical, financial, or other professional advice.

7. No guarantee of results

Search engines and AI assistants rank, cite, and recommend content according to systems we do not control and that change without notice. We do not promise or guarantee any particular outcome from using the Service — including rankings, citations, recommendations by any AI engine, traffic, leads, or revenue. Metrics shown in the Service are estimates based on data available to us and may be incomplete.

8. Acceptable use

You agree not to:

• use the Service for anything unlawful, deceptive, or infringing, or to publish content that is defamatory, malicious, or spam;
• interfere with or disrupt the Service, probe or test its security without written permission, or access it by any automated means other than its intended interfaces;
• reverse engineer the Service or use it to build a competing product;
• resell or provide the Service to third parties as a service bureau without our written agreement; or
• circumvent usage limits or use another customer's account.

We may suspend or limit accounts that we reasonably believe violate this section.

9. Our intellectual property

The Service, including its software, design, and branding, is owned by EasyScale and its licensors. These Terms do not grant you any rights in the Service other than the right to use it while your account is in good standing. If you send us feedback, we may use it without restriction or obligation.

10. Third-party services

The Service depends on third-party services, including payment processing (Stripe), AI model providers, search engines, and the platforms you publish to. Your use of those services is governed by their own terms, and we are not responsible for their availability, performance, or changes to their behavior or pricing.

11. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms, if your payment fails and is not cured, or if we discontinue the Service (in which case we will give reasonable notice). Upon termination, your right to use the Service ends; sections of these Terms that by their nature should survive (including Sections 6, 7, 9, and 12–15) survive.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT OUTPUT WILL BE ACCURATE OR RELIABLE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYSCALE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR US $100 IF YOU HAVE PAID US NOTHING).

14. Indemnification

You will defend and indemnify EasyScale against claims, damages, and expenses (including reasonable attorneys' fees) arising from content published to your properties, your use of the Service in violation of these Terms, or your violation of law or third-party rights.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association, and you and EasyScale each waive any right to a jury trial or to participate in a class action. Either party may instead bring an individual claim in small-claims court.

16. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will give notice (for example, by email or a notice in the Service) before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
